1. Acceptance of These Terms

2. Eligibility

jurisdiction, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound
by these Terms. By using the Services you represent that you have the legal capacity to enter into these Terms.
3. Accounts
You may browse the Services without an account, but some features (saving displays, posting reviews, uploading photos,
submitting displays, voting in Awards) require registration.
– You agree to provide accurate, current, and complete information when creating your account and to keep it updated.
– You are responsible for maintaining the confidentiality of your account credentials and for all activity under your
account.
– You must notify us promptly if you suspect unauthorized access to your account.
– We may suspend or terminate accounts that violate these Terms, are inactive for an extended period, or that we
reasonably suspect of fraud or abuse.
4. Acceptable Use
You agree not to:
– Violate any applicable law, regulation, or third-party right.
– Post content that is unlawful, defamatory, harassing, hateful, threatening, obscene, sexually explicit, invasive of
privacy, or that promotes violence or illegal activity.
– Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
– Post content about a private residence that is not visibly decorated for public viewing without the resident’s clear
consent.
– Post personally identifying information about others (full names combined with home address, phone numbers,
identifiers of minors, etc.) without their permission.
– Solicit, promote, or facilitate any commercial activity through the Services except as we expressly permit.
– Use the Services to distribute unsolicited advertising, spam, chain letters, or pyramid schemes.
– Attempt to gain unauthorized access to the Services, other user accounts, or our systems, or interfere with the
operation of the Services (including scraping, denial-of-service, or introducing malware).
– Circumvent, disable, or interfere with security or content-protection features of the Services.
– Use the Services to harvest email addresses or other personal information for any purpose.
– Use automated systems (bots, scrapers, spiders, crawlers) to access the Services except that we permit well-behaved
crawlers that honor our robots.txt.
– Reverse engineer, decompile, or attempt to derive source code from any of the Services except as expressly permitted
by law.
We may enforce these standards at our discretion. We are not obligated to monitor content but may do so.
5. User Content
5.1 Ownership
You retain ownership of any content you submit to the Services (“User Content”), including display submissions,
reviews, ratings, photos, videos, comments, and decorator claims.
5.2 License to Us
By submitting User Content, you grant Christmas Lights Near Me, LLC a worldwide, non-exclusive, royalty-free,
transferable, sublicensable, perpetual, and irrevocable license to use, host, store, reproduce, adapt, modify,
translate, publish, publicly display, publicly perform, distribute, and create derivative works of your User Content in

known or later developed. This license survives termination of your account with respect to User Content you have made
public.
5.3 Your Representations

season.
5.4 Our Rights
We may, but are not required to, review, edit, refuse to post, remove, or take down any User Content at our discretion.
We may remove content that violates these Terms, our community standards, or applicable law, and we may terminate
accounts of repeat violators.
5.5 Reviews
Reviews must reflect your genuine, personal opinion based on actual experience. You may not post reviews:
– In exchange for payment, discounts, or other compensation not disclosed in the review.
– On behalf of a competitor to disparage a display.
– That contain content prohibited by Section 4.
6. Displays Listed on the Services
Displays listed on the Services are homes and other properties visibly decorated for holiday viewing from public
rights-of-way. Christmas Lights Near Me, LLC aggregates and organizes publicly-observable information contributed by
users and editorial staff. Listing a display on the Services does not mean the property owner is affiliated with,
endorses, or has consented to inclusion on the Services.
Requests to modify or remove a listing. If you are the resident or owner of a listed property and wish to have your
listing removed, updated, or restricted, contact us at info@tackylighttour.com with proof of your relationship to the
property. We will act on legitimate requests within a reasonable time.
Visiting displays. Displays are private property. Please observe from public rights-of-way, respect residents and
neighbors, follow local traffic and parking laws, and do not trespass. Christmas Lights Near Me, LLC is not responsible
for your conduct or for any interaction between you and residents.
7. Awards and Voting
We conduct an annual “Tacky Awards” program with fixed categories. Each registered user may cast one vote per category
per award season; a subsequent vote replaces the earlier vote. Results are aggregated at season end and are subject to
editorial review. We may disqualify votes we reasonably determine to be fraudulent, automated, or otherwise not the
good-faith votes of individual users. Award outcomes are final; the awards are for community-recognition purposes and
confer no legal rights, prizes, or monetary awards unless expressly stated for a specific promotion.
8. Deals, Advertising, and Affiliate Disclosures
We publish holiday-lighting and seasonal deals sourced from third parties. Some deal links may be affiliate links,
meaning we may earn a commission if you make a purchase after clicking. Deal prices, availability, terms, and merchant
reliability are determined by the third-party merchant, not by us. We make no warranty as to the accuracy,
availability, or fitness of any product or service listed in a deal.
The Services display third-party advertisements (including through Google AdSense). Your interactions with advertisers
are between you and the advertiser; Christmas Lights Near Me, LLC is not a party to those transactions and is not
responsible for advertisers’ products, services, or content.
9. Email Communications

12. Feedback

14. Limitation of Liability

EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATED TO
YOUR USE OF THE SERVICES, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF
(A) ONE HUNDRED DOLLARS (US$100.00), OR (B) THE AMOUNTS YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT
GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the exclusions
and limitations above will apply to the fullest extent permitted by law.
15. Indemnification

contractors, agents, licensors, and suppliers from and against all claims, damages, losses, liabilities, and expenses

17.1 Informal Resolution First

17.2 Binding Individual Arbitration
Any dispute, claim, or controversy between you and Christmas Lights Near Me, LLC arising out of or relating to these
Terms or the Services that is not resolved informally will be resolved through binding, individual arbitration
administered by JAMS or AAA under its then-current consumer arbitration rules. The arbitration will be
conducted in Fulton County, Georgia, or, at your election, by telephone or written submissions. Judgment on the award
may be entered in any court of competent jurisdiction.
17.3 Class-Action Waiver
YOU AND CHRISTMAS LIGHTS NEAR ME, LLC AGREE THAT CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A
PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not
consolidate the claims of more than one person and may not preside over any form of representative proceeding.
17.4 Small-Claims Carve-Out
Either party may bring an individual claim in small-claims court instead of arbitration if the claim qualifies under
the court’s rules.
17.5 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent
jurisdiction to protect its intellectual property rights or confidential information.
17.6 Opt-Out Right
You may opt out of the arbitration agreement and class-action waiver by sending a written notice to us at Christmas

the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia.
18. Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the “Last Updated” date and, if the changes are
material, provide reasonable notice (for example, a Site banner or email to registered users). Your continued use of
the Services after the effective date of any change indicates your acceptance of the modified Terms.
19. Miscellaneous
– Entire Agreement. These Terms and our Privacy Policy are the entire agreement between you and Christmas Lights Near
